Nice work on the colouring an' all, but if you're going to copy someone elses work, at least make a mention of the original artist. Otherwise what you're doing is plagiarism .

I think the tracing Idea came from the fact that it's, one, exactly like that original, small details and all, and two, because the lining is very light and uneven just like your hand was following a path, not creating it.

Laying your image over the original as in the attached image (there's no way I'm gonna get busted for posting this crap in my own photobucket account) reveals an uncanny similarity between the original lineart and your own. The fact is that it's EXCEEDINGLY difficult to copy a picture so well. It's even harder to believe you actually drew it because your lineart is, frankly, crap; generally, people who can draw in a more realistic style are capable of inking their pictures.

yes I know, using "chara" instead of character has become a bad habit for me (thank IRC for that)
as for my comic, I do tend to use a library of stock pose recourses, but I hardly consider that "tracing" if you have a problem with that, then that's just it, your problem

Well, I haven't read your comic, but if you "use a library of stock pose recourses" in the same way that you "used the same pose" for the character there, then in fact it is not our problem. the pose libraries I use are for example stock poses collected FOR THE PURPOSE of basing drawings off of, as such they are usually considered (for the most part) fair use for that purpose

You are digging yourself a hole here. I like to think that people are smart enough that if they are going to do evil, that they won't be caught. However as my time working in various customer support departments has proven, people make shit up to cover their incompetance or not wanting to take responsiblity for their actions.
Just admit that you traced it and tell us who and where it was traced from. You should also do the same for your comic, otherwise you are going to rip off the wrong person and that person will come with an army of lawyers.

U.S. Copyright law is quite explicit that the making of what are called "derivative works" -- works based or derived from another copyrighted work -- is the exclusive province of the owner of the original work. This is true even though the making of these new works is a highly creative process. If you write a story using settings or characters from somebody else's work, you need that author's permission.
