It would be the one, but be called the other.

Legally speaking, "assault" is the threat or promise of violence... Whether I say "I'm gonna smack you!" or simply hold my hand up in a threatening manner, as if I were going to smack you. "Battery" is the actual violence delivered. "Assault and battery" would be where I threaten you with violence, and then follow through withthat threat. The former is a crime because of it's use as a coercive tool.

In the common street language, of course, "assualt" has come more to mean "battery".
